There are some games that very emphasize claiming an area for grinding but BDO is certainly not one of them due to the mechanic of the game. It's ridiculous to even ask people to duel for a spot when the reality is if you die from pvp you can come back with just a click of a button. We shouldn't enforce something onto others when the game mechanic of game has no place for duel for spot. The duel for spot rules is made believe.
Now let show you an example when duel of spot is a thing of non-fiction like back when some mmo players including myself were playing "Tibia" they emphasize strongly on claiming an area for oneself because the mechanic of the game is meant for it.
I think PewDiePie explains it best in his video

We do not have any of these mechanics in the game listed above ^ since BDO is not Tibia ten years ago.
Duel for spot is not part of the game mechanic or something the devs have implemented it's almost as fictional as roleplaying.
What is this recent obsession for DFS many of you have?
Use it, or not. That's only a proposal in the end, accept it, refuse it, accept it then do not respect it if you lose, who cares? Nobody can enforce it anyway, that's a pure fantasy. So why bother complaining?

Problem is the people that are for it dont propose it. They demand it.

Exactly an this can be clearly seen because even though there asking an you say no they still try PVP you for the spot. If you were asking than they would just leave when told them no, but there clearly not asking cause even when told no they engage in fighting you.

And? Same result, don't feel forced to accept a duel.
We're talking about the idea of "duel for spot" precisely, aren't we? So what happens after a refusal is another thing. I wouldn't blame players for trying to do it their own way, even if I will not necessarily agree with them.
I ignore the silly duel requests. If I am there first, I see no reason to duel. I won't ever leave, either. Have fun!

Because it's being used an excuse for toxic behavior. The intruding party will try to claim you refused a duel so they now have a reason to PK or mob feed.

Since when toxic players need a reason like that to PK or mob feed anyway? Do they need one for bodythrowing? XD
Toxicity needs no reason like that.
However, these are available tools, use them as you see fit, or not. But don't be surprised if the other does the same.

The fact is that it gives an extra layer of excuse for players to be toxic regardless of whether you can accept that or not.

Because they are so hypocritical that they need to use pathetic excuses to justify their kid like toxic behaviour and play the victim iin the process.
