The reason that we nowadays have so many players not looking for PvP is because they came here withing informing themselves of what BDO is and then cry later to change it, basically like you are doing right now.
How about you don't play a game that has things you don't like? Ever thought about that?
But no, then they come with "but I want to do X" or "but BDO has Y"...cool, but you should not try to change the core gameplay of bdo which is PVPVE. If you don't accept it, then this game is not for you.
Pearl Abyss sent a clear message to everyone that THEY don't want the environment you want to push. YOU don't belong in BDO.
Pearl Abyss does NOT want to harm it's players with death penalties, prevent them from killing world bosses and to create a non sustainable game environment.
If Pearl Abyss cared about what YOU wanted the wouldn't have made all the changes against YOU. YOU don't advocate for private instances, it's literally ANTI everything YOU want BDO to be.
Guess what PRIVATE INSTANCES where put in the game where YOU don't belong.
Enjoy your time somewhere else. This just isn't the best fit for you.

Sorry, a better option is just to lose you as a customer so a few forum warriors can dream of having a PVP game.

There are TWO sides. What is good for the game, which is what I am referring to and the the current game. In the current game I can plow right over anyone I want and force people out of any spot I feel like. All that's needed is to be more persistent, exploit the systems more than your opponent and be more obnoxious than they are.
And YOU fully support that behavior. It's called PLAYER vs PLAYER. It doesn't break any policies, but it's certainly NOT GOOD FOR THE GAME.
I'm more of a hardcore PVPer than you could imagine ;)

As most often the case you do not dominate PVP games with being the most skilled. Whoever is willing to exploit the game the most wins. You do not out skill the broken mechanics all over the game.
A simple example was the old Witchzards meta. The clan that won was the one that brought the most of the broken class, no skill required.
The PROBLEM is dominating this way while it's the most effective method is ALWAYS less productive than private instances. WASTING your time just to beat down another player is boring and a LOSE/LOSE. It's EFFECTIVE, but terribly boring broken janky game play.
Sure I can stuff anyone who tries to take my spot, but do I really WIN in that situation? NO
As soon as I force that player out another one will just replace them anyway. There is NO WINNING even with 100% invincibilty to all deaths/mob feeding.
If anyone has issues with someone trying to mob feed them keep in mind you have a ONE click option now to NEVER lose crystals ;)

It's all 100% relevant as you want to implement those PVP rules into TODAY'S current game.
You simply don't want to accept the fact that players are NOT really looking to PVP. The ONLY reason people even claim they want OWPVP is to "protect their grind spot".
If that was actually true Private Instances protect it 100% of the time and THAT is the solution to their ficticious problem of everyone just grinding in their face despite the FACT that I can't find those people even after 10,000's of hour grinding at this point.

It means that, YES, when they go in open world, players are mainly looking for pve. That's the idea my friend, you go for pve and pvp might happen ; it is even true on Arsha, you go there for the increased drop rate and the increased possibility to use pvp for a spot.
(on a side note, I personally think it's the reason why Arsha is not a success, the rules are what gives meaning to the fact of becoming an outlaw. If there's no law, how can you be an outlaw?)
At the same time, devs wanted to guarantee a safe way to progress, we got Marni.
In the end... It all makes sense in a regulated PvPvE setting, but you keep trying to see the game under a more hardcore pvp point of view. This is not old-school L2, far from it. And that's intended.

Players do not want to defend their spots nor can they. There is no value in trying to pk anyone, thus it's either mob feed or hoping to exploit the one war system. Which might actually get fixed. You are not supposed to circumvent the karma system by a one way war.
Ashes of creation system spells out a proper way to do this. So did every other PVP system with penalties.
Pearl Abyss is the ONLY game developer that didn't figure out how to do it correctly.
The end result is NOT PVP and all the complaints suggest no one is enjoying it. They are NOT HAPPY about having to force people out of their spots (which are spots they try to steal from others, lets be honest). The player being harassed isn't happy nor is the griefer regardless of the situation.
It's a LOSE/LOSE system designed by developers that don't have a fundamental understanding of how MMO's work. They have this delusion it's some kind of giant Shadow Arena and simply can't figure how to design the game properly.
One thing is for certain though. NONE of the suggestions from so called PVPers would help with game retention or increasing the player base. The ONLY place their ideas would take the game is into the dumpster.
In that context both regulate and protect mean the same thing.
